This document provides guidance on assessing and supporting children and families with no recourse to public funds. The guidance outlines the process of assessing eligibility for support and the assessment of need for families with NRPF within the current legal context. It addresses issues that need to be taken into consideration in completing human rights assessments on families with NRPF.
The guidance also considers common scenarios in detail, including: families fleeing domestic violence, families that have overstayed their visa, safeguarding duties of local authorities, EEA nationals, expectant and nursing mothers, voluntary return and leaving care provisions.

This guidance outlines the process for assessing the eligibility of adults with NRPF for support from a local authority, followed by a detailed consideration of the assessment process. The guidance takes into account the impact of the M v Slough ruling (2008) on this assessment process.
The guidance also covers human rights assessments on adults with NRPF, and also looks at common scenarios in detail, including: adults fleeing domestic violence, expectant and nursing mothers, those that have overstayed their visa and EEA nationals.
