Fixed Penalty Notices

Under the Clean Neighbourhoods and Environment Act 2005, authorised officers are able to issue a range of fixed penalty notices as an alternative to prosecution as a last resort.

In the first instance Islington Council officers raise awareness and inform residents, businesses and visitors about their roles and responsibilities as regards to the disposal of their rubbish, dog control and other local environmental quality issues.

When an offence is identified an offender is given a chance to rectify their actions, and is offered further advice and support.

When necessary Islington undertakes enforecement action in a reasonable, equitable and proportionate manner.

Offences for Fixed Penalty Notices

Depositing litter (CN1)

Issued when rubbish or litter, including smoking related litter, are disposited on any land in the borough and left there.

Unauthorised distribution of free printed matter on designated land (CN2)

Issued when free printed material is distributed without consent or outside the terms of agreement on designated land.

Failure to comply with a dog control order (CN3)

Issued when any applicable dog control offence is committed with a designated dog control area.

Graffiti and fly posting (CN4)

Issued when an offence is committed under any specific legislation that makes graffiti and fly posting illegal.

Failure to comply with a Street Litter Control Notice or a Litter Clearing Notice (CN7)

Issued after a street liiter control or clearing notice has been served and any of the items have not been complied with.

Failure to comply with a waste receptacle notice (CN9)

Issued after a waste receptacle notice has been served and any of the tiems have not been complied with.

Failure to produce documentation (Waste Carrier's Licence) (CN11)

Issued after a request for the production of current documentation has not been complied with within the timescale and manner prescribed.

Failure to produce authority (waste transfer notes) (CN12)

Issued after a request for the production of current documentation has not been complied with thin the timescale and manner prescribed.
