The independent Schools Adjudicator has said yes to the St Mary Magdalene Academy - Islington's brand new secondary school - in Holloway.
Although an earlier adjudication had given the go ahead to the scheme in July 2005, it had to be re-referred to the Adjudicator because planning approval conditions had not been met by September.
On making his decision Schools Adjudicator, Andrew Baxter concluded that the governors' proposal is likely to enhance the standards which the school has achieved, and to provide valuable opportunities for further development.
The clearing of the site will continue and it is anticipated that construction will begin in the summer term.
The scheme had already found favour with the Government Office for London, The GLA and the council's planning department which gave permission to the scheme in December 2005.
Cllr James Kempton, executive member for children and young people said:
"There must be very many relieved parents in Islington. I am delighted that we have the Adjudicator's support for our ambitious education plans.
A new school - fit for the educational challenges of the 21st century - will open in September 2007.
Results have improved strongly since 2000 - now facilities are improving too. As well as the academy we want to improve all of our 9 secondary schools with a massive rebuilding and refurbishment programme over the next 5-7 years. New schools will give our young people a better educational experience, a sound start in life and make the borough a first choice for Islington parents."
The adjudicator's approval is subject to the funding agreement, the formal agreement for the establishment of the Academy, being signed by the end of June 2006.
